Sabine McNeill to appeal sentence this week

Sabine McNeill, who was found guilty in December 2018 on four counts of stalking and six counts of breaching her 2016 restraining order, has received leave to appeal her nine-year sentence, reduced from 12 years on account of her age. Her appeal will be heard on Tuesday, 30 July, at the Royal Courts of Justice in London.

We first learned that Sabine might have received leave to appeal her sentence two months ago, via a somewhat garbled announcement from her friend and sometime co-defendant, Neelu Berry.

Yesterday, Neelu published a slightly more coherent group email from Belinda McKenzie, offering a few further details:

According to Belinda, if Sabine’s appeal is successful she will once again be able to go online and share the amazing contents of her mind with the world. We suspect that this might not be a winning argument in court, as Sabine’s trial amply and vividly illustrated the tragic consequences of her having done just that.

In fact, Belinda’s argument that “whether still inside or…out on licence she can still use snail-mail and the telephone” is hardly reassuring to her victims, as two of Sabine’s restraining order breaches involved just such “analogue” activity once she’d been banned from using the internet while she was awaiting trial. Readers may recall that the last of these breaches resulted in her being remanded in custody for nine months prior to her trial.

It’s interesting to note that in contrast to Rupert Quaintance, who unsuccessfully appealed both his sentence and his verdict in October 2017, Sabine has only won leave to appeal her sentence. We don’t know whether she sought leave to appeal her verdict as well, but if she did it was turned down.

We’ll be following her appeal hearing, and will publish updates as soon as they become available.

    And yes, if Sabine’s got any sense she’ll ignore Belinda’s ‘advice by proxy’ and not tell the appeal judge that she’d like to carry on doing the stuff she got banged up for in the first place 🙄

    And it’s interesting what you say about Sabine only appealing her sentence and not her verdict, as it sounds like Belinda hasn’t quite grasped that. And it certainly doesn’t seem to have filtered down to the Sabine-supporters commenting under Neelu’s post:

    On a side point, do I take it Neelu’s glory days are behind her? Time was she used to regularly channel Lord Ashtar and Abraham Lincoln. And now the most distinguished luminary she can muster up is, er, Belinda? 🤦‍♂️

    • Keep in mind, she got “banged up” this time, for breaching a court order from the last time. Methinks any judge will basically say “You were told to not post etc. You still posted on multiple occasions and deliberately placed vulnerable persons in harms way. There is no doubt that, if released, you would continue to do so as you believe laws don’t apply to you.”

      Personally, I’m hoping to see it raised to 12.

    • I do hope her little friends turn up at court tomorrow. They were very helpful in illustrating to the judge at Sabine’s trial exactly what she had unleashed on an unsuspecting community.

      • Well, technically you can appeal if you pled guilty but this is usually only on the grounds of the plea not being voluntary, was pleaded on the basis of an erroneous ruling of the trial judge or if fresh evidence comes to light which undermines the safety of the conviction.

        However, as Neelu isn’t Noakes’ solicitor it will probably go in the bin.

        As for Sabine, one of the hazards of appealing a sentence is that it can also be increased. Her best hope would have been that her original sentence quelled the internet fever and her acolytes kept a low profile and ended their course of harassment. She could then try arguing it was excessive in order to satisfy the aims of justice angle.

        That they continue to harass people and make death threats might severely undermine her case and confirm the seriousness of Sabine’s actions if the CPS have been keeping on top of the continuing threats to innocent people from her supporters.

        • I’ve never heard of such a long sentence being abandoned. I think at best 2 or 3 years shaved off but there would have to be compelling reasons such as mistakes in the sentencing remarks.
          I don’t wish McNeil any harm and was actually quite shocked at the length but then I wasn’t there to hear the victim’s testimony and an Appeal judge would have to take that into consideration.
          It’s not unknown for judges or magistrates to give sentences they know will be changed on appeal.

    • It’s the public’s duty to inform The Met’s Protection Command who provide the Royal Protection Officers about those who post death threats against any royal. They cannot afford to take a chance. Either this mob are dangerous or could inspire an unhinged person to take action.

      I am not an expert but I believe the hospital staff are in a position to invoke the Privacy Act..Any Youtuba or Faceborg entry using clandestine recordings is possibly illegal.

      • By now word would have gone around to all hospital staff to ignore these harassing idiots and not to indulge them and I should think NZ cops as well after Colin Devine’s mind-numbing rants.
        The hospital’s duty is to look after Wanoa’s health and that includes booting his daughter if she causes trouble.
        I guarantee Wanoa has settled in nicely for the long term. Probably been complaining they don’t serve fish and chips enough. Part of sectioning is to give the patient a long break from their daily life which impacts on their mental health.
        I reckon also some characters like that Arthur in Sydney moan to their online pals as their egos won’t allow them to say they are doing well.
        I have a friend in Sydney who knows the hospital Arthur has been in twice and he describes it as like a holiday camp with comfortable cottages where patients live, lots of recreation and extensive park lands.

  3. In Belinda’s email that Neelu shared, Belinda said: “..whether still inside or hopefully out as of next week out on license..”. That can’t happen, can it EC? Sabine can’t be let out on license without serving her sentence, can she?

    • If I’ve understood correctly, she can’t be let out at all, as she’s not appealing the verdict, just the length of the sentence.

    • Well, if her sentence were reduced to less than or equal to the time she has already served x 2, she would be released on licence. And if it were reduced to less than or equal to the time served, she would be released unconditionally.

      E.g. if she had served 12 months and the sentence was reduced to 24 months, she would be released on licence. If it was reduced to 12 months, she would be released unconditionally.

      If I were to take a punt, I wouldn’t be surprised at a reduction of a year or two. It was a long sentence and she’s 75. But the assessment of the judge, who was there, is taken very seriously by the CA. However it’s very risky guessing what the CA will do – so much of it depends on the submissions.

      I’m not surprised she isn’t appealing conviction, as the evidence was about as strong as it gets. She will probably have been advised not to for fear of a loss of time order which would increase her sentence by over 6 months. I wouldn’t expect a loss of time order in an appeal against sentence as it doesn’t look hopeless and I’m assuming the single judge gave leave.

    • The sad irony is that if Edward Ellis was to die due to not going to the hospital for help then Andy Devine will blame the hospital and medical profession. Even though Devine constantly tells folk how he doesn’t go to the hospital and neither should other people.

    • I have already said this on Quatloos, but I seriously think nothing is going to happen with Neelu and others until EWE ends up dead because of the advice he gets from struck off pharmacists and others. If someone is suggesting conventional medicine like the dialysis he appears to need, then they will all fall out with each other again.

    • Don’t know for sure in the UK, but NZ and Australia have had the ‘crime reporting number’ (and a lot of other ‘non police work’ like paperwork etc) hasn’t been done by ‘uniforms’ for years…
      Why tie up a police officer doing ‘non police work’ when they could (and should) be utilized actually doing- you know- police stuff…
      Police are expensive to train, and get paid more, so you don’t want them just ‘paperpushing’

  7. I assume commenters here saw that Valerie Sinason had a letter published in the Guardian in the wake of the Beech verdict? It is not the letter which bothers me but the fact that the Guardian published it, and the large number of signatories, presumably all mental health professionals of some sort or other.

    • It’s rather difficult to understand; I suspect the author speaks English as a 2nd language.
      One of the things they appear to be saying is a particular sort of “no smoke without fire” i.e. Beech must have been abused in order to have the sort of personality who comes up with these sort of falsehoods. I think there may be a germ of truth in this. But I’m not sure where it gets us. Of the people whom he accused, the only one who wasn’t completely exonerated by the investigation of Northumbria Police and the CPS was his stepfather, and even some of that story was inherently unlikely. And even if he were, it’s limited mitigation: it’s not an inevitable consequence of being abused.
      But beyond that they still insist on there being a paedophile ring linked with No 10, despite the fact that there is no evidence of it at all, and despite the police investigating. Underneath it appears to be the discredited Elm Hall Guest House allegations and the conviction of Peter Righton, who was a child abuser connected with some educational institutions and charities, but hardly at the centre of power.

        It’s a fairly common defence of quackery and for scam artists & conspiratorial thinkers that tries to (incorrectly) throw the burden of proof away from the claimant, “…but why would they lie?” apparently having never met human beings before.

  10. Omg how can Belinda coach her into carrying on with her activity on line It’s a sure way to get sent back if released. Belinda is a manipulative cowardly person she wants other people to do her dirty work whilst she sits back and pretends she’s know part of it when things go pair shaped. I doubt very much she will be released probably time added on or time taken off given her age but definitely won’t be released.

    • I think it pretty much boils down to whether the police and CPS have been keeping on top of the ongoing threats from her supporters. If they have I could see it being kept the same or increased as there is a clear nexus between her actions and their continuing behaviour. If they haven’t kept on the ball then it will be a poor little 75 year old in front of the appeal judges, hobbling in on crutches and making her puppy dog eyes about her “long” sentence.

      She’s served just over 18 months, if you include tagging and remand, it will need to be reduced to under approx 4 years for actual release.

      [Side note: Always found it odd that you get a lesser sentence for crimes as you get older. Not saying it’s not right, but hit 70 and you have by and large a free hit!]

      Well, it looks like I’ve won the Sabine Challenge Prayer Off as APD’s intercessions have been lost in the void. I was pretty confident as I won the challenge last January as well, but it’s never a good idea to get complacent.
