DECISION

Q1: The MPS neither confirms nor denies that it holds the information you have requested for this question as the duty in Section 1(1)(a) of the
Freedom of Information Act 2000 does not apply by virtue of the Section 40(5) exemption.  

Q2-6: The MPS is satisfied that you are seeking an opinion for these specific questions, for which there is no requirement for the MPS to create information.

Q7: The MPS can advise that it will not be possible to respond to this question within the cost threshold.  

This response serves as a Refusal Notice under Section 17 of the Freedom of Information Act 2000 (the Act).  Please see the legal annex for further information on the exemptions applied in respect of your request.

REASONS FOR DECISION

In regards to Question 1: A Freedom of Information Act request is not a private transaction. Both the request itself, and any information disclosed, are considered suitable for open publication. This is because, under Freedom of Information, any information disclosed is released into the wider public domain, effectively to the world and not just to one individual. In most cases Personal Data is exempt from disclosure under the Freedom of Information Act as I will explain below.

To confirm or deny whether personal information exists in response to your request could publicly reveal information about an individual or individuals, thereby breaching the right to privacy afforded to persons under the Data Protection Act.

In regards to Questions 2 – 6: Please note that requests made under the Act are for information held by a public authority at the time a request is made. The ICO clarifies that there is no requirement for a public authority to create information or provide opinion in order to respond to a request unless this is already held in documents or other form.

In regards to Question 7: As this information is not recorded in the format you have requested we have considered how to locate this information.

Initial enquiries were made within the Performance and Assurance Unit (PAU), who prepare statistical information for the MPS, to determine how we would extract the information relevant to your criteria.

Our Crime Reporting Information System (CRIS) allows the individual creating the crime report to select from a number of branch flags. The branch flag that best suits your request is ES – Child Sexual Exploitation. Unfortunately, this particular flag was only introduced on CRIS from April 2013 and does not indicate if ‘organised’ as you have requested.

Therefore, to determine if any records (containing the branch flag of ES) is relevant to your request, would require a member of police staff to manually read thousands of CRIS reports to determine if they were relevant to your request.

All records would need to be read as it would not be known whether or not the report contained any pertinent information to determine if the offence was ‘organised’. This process would clearly exceed the appropriate threshold of 18 hours in order to determine if held, locate and extract.

We therefore estimate that the cost of complying with this request would exceed the appropriate limit. The appropriate limit has been specified in regulations and for agencies outside central Government; this is set at £450.00.  This represents the estimated cost of one person spending 18 hours [at a rate of £25 per hour] in determining whether the MPS holds the information, and locating, retrieving and extracting the information.

Section 16 Advice and Assistance

I would like to provide you with some advice and assistance as to how you may narrow your request so that it does not exceed the appropriate limit.

In regards to Question 7 – You may wish to narrow your request for the number of CRIS reports containing the Branch code of ES (Child Sexual Exploitation) since its introduction in April 2013, broken down by financial year (April 2013 to July 2017).

Please note that any narrowed request will be treated as a new request for consideration under the Act and may be subject to exemptions. This can be made by emailing [email address]

LEGAL ANNEX

Section 17(1) (5) of the Act provides:

(1)  A public authority which, in relation to any request for information, is to any extent relying on a claim that any provision of Part II relating to the duty to confirm or deny is relevant to the request or on a claim that information is exempt information must, within the time for complying with section 1(1), give the applicant a notice which-
(a) states that fact,
(b) specifies the exemption in question, and
(c) states (if that would not otherwise be apparent) why the exemption applies.

(5) A public authority which, in relation to any request for information, is relying on a claim that section 12 or 14 applies must, within the time for complying with section 1(1), give the applicant a notice stating that fact.

Section 12(1) of the Act provides:

(1) Section 1 does not oblige a public authority to comply with a request for information if the authority estimates that the cost of complying with the request would exceed the appropriate limit.

Section 16 of the Act provides:

(1) It shall be the duty of a public authority to provide advice and assistance, so far as it would be reasonable to expect the authority to do so, to persons who propose to make, or have made, requests for information to it.

(2) Any public authority which, in relation to the provision of advice or assistance in any case, conforms with the code of practice under section 45 is to be taken to comply with the duty imposed by subsection (1) in relation to that case.

Section 40(5) of the Act provides:

(5)  The duty to confirm or deny-
(a) does not arise in relation to information which is (or if it were held by the public authority would be) exempt information by virtue of subsection (1), and
(b) does not arise in relation to other information if or to the extent that either-
(i) the giving to a member of the public of the confirmation or denial that would have to be given to comply with section 1(1)(a) would (apart from this Act) contravene any of the data protection principles or section 10 of the [1998 c. 29.] Data Protection Act 1998 or would do so if the exemptions in section 33A (1) of that Act were disregarded, or (ii) by virtue of any provision of Part IV of the [1998 c. 29.] Data Protection Act 1998 the information is exempt from section 7(1) (a) of that Act (data subject’s right to be informed whether personal data being processed).

      I still have my treasured Famous Five book from the 1960s and in it the crew go to an island where smugglers are suspected of using secret tunnels. I’m writing to the MPS to ask them how many cases are there of smugglers using secret tunnels on islands and whether they involved child trafficking and if the smugglers were in fact, Satanists.

            To me, that’s all about as believable as his claims that Donald Trump is targeting him with remote microwaves to shut him up, that his smoke alarms are cameras in disguise and that the rocks in his garden are trying to kill him.

            Mind you, I do worry about what he might do in the future. He clearly has murderous and violently sexual urges and he has previously threatened to kill his neighbour’s children (hence the restraining order), prayed for various people, including us and our children, to die in agony, and dropped hints about going on a shooting spree (which he later frantically denied when he realised the seriousness of what he’d said). And worryingly, he does live in a country which stupidly allows people to own guns.

          • Doris’s frigging perforated ear-drum is healing but Christ it takes a long time. Have been having acupuncture for the Tinnitus that accompanied it and it’s a great help.
            Mine was caused by an infection- the very notion a grown man would belt a kid and cause such damage…grrrr.

          • When you routinely get grilled like a kipper at customs for simply having dark skin a beard and a ‘foreign’ name (despite being born, bred and coming from a family that’s been here for over 150 years), it’s really quite difficult to gather any sort of ‘tolerance’ for preppy pasty-faced septics who have actually involved themselves in social terrorism, and about who actual legitimate concerns have been raised, being allowed to just breeze through without a word.

          • …Yes DotB, a kipper is a fish; specifically a smoked haddock, normally cooked by grilling. Another expression we use over here is “done up like a kipper”, traditionally they come tied up in pairs and are smoked by being humg over a pole.

            – Last time I visited the states (and it will be the last fucking time, we paid good money to be treated like shit) for a family holiday I, my wife and two then very little kids, were six hours being ‘processed’. I can’t remember the last time I walked straight through UK customs; to the point where the Mrs just won’t hear of a holiday abroad – it’s too distressing for the little ones.

It was my great-great grandfather than brought the family here in the 1870s as part of the house staff of a colonial mission family coming ‘home’. I was brought up Episcopal and until I was 22 had never been further East than Great Yarmouth! – I can’t walk straight back into my own country but some bloody foreigner who’s stated intent is to cause mayhem can! – Summat not right there!

    Of course they do… And it was bloody-obvious that they would respond in that way to Sabine’s idiotically-nebulous requests.

    Cost threshold (and other factors than influence FOI responses) are something that competent, serious researchers, who really do want to drill down to answers, are well aware of. i.e. If you do really plan to hold a government department’s ‘feet to the fire’ you work in such a way as to pin them down so they can’t just wriggle out of it…

    Of course, if you’re not really serious about drilling into these things, and instead just looking to blow scandalous smoke, you make stupid, ‘designed to fail’ approaches like this then start wailing about ‘cover ups’… In reality, this plays straight into the ‘bent as a four-pound note’ element within these services!

Another technique you see often is that they start a letter-writing campaign against someone like like the Queen or Prime minister about things they know full well these people are constitutionally barred from responding to. Then, when they’re either ignored or referred to the right department, they start banging on about how Lizzy’s a shape shifting reptile and Theresa May’s marinading tandoori toddler.

          • A responsible dog owner feeds dogs separately so they don’t have the chance to fight over food. Same with toys. When I look after my friends dogs, I make sure all the toys are put out of the way, and they are fed in separate rooms. There is no excuse really.

They are practically begging people to stalk them to give their lives some meaning and get some attention.
        I won’t link to any of their videos, but this is the sort of advice their so called followers and friends give them, instead of telling them to see a mental health professional.

          • I did point out to a person in the comments section of one of their videos that what they were experiencing is not gangstalking or being targeted, just because a friend came over and brought a freind of theirs with them that happened to mention eating a banana doesn’t mean they were spying on you earlier when you had eaten a banana, and mentioned seeking some form of help from a professional.
            They didn’t respond, but a guy did telling me to “go kill myself”.
            So I looked at that persons YouTube account and sure enough they had a large following in the T.I. community, claimed they were a victim of gang stalking then had every single piece of personal information you could think of about themselves on there main page. They were also selling many products to other targeted individuals, so I was effectively messing with their money and clients by offering advice.
            They also had the usual GoFundMe Accounts including one where they wanted people to buy them a house.

            It’s a business for these creeps preying on those with mental illnesses. Promote the problem, sell the solution.

      • They do play on our emotions, and it’s important to take some time away from the computer and not let them get to us. It’s depressing to think that people can really be that idiotic, but we have to remember that we’re not out to save the whole world. And even if we were, if we didn’t look after ourselves and take mental health breaks from time to time, we wouldn’t be very good at it.

        I know you feel passionately about all this, and that’s great, but believe me, you can’t immerse yourself in it 24/7 and stay mentally healthy. It’s depressing and anxiety-provoking, and breaks are essential. Even a quick walk around the block, or half an hour playing with a dog or cat, or a trip to my nearest coffee shop to chill out a bit…it’s how I stay sane and focussed.

    • Those people have been rescued now. Residents of Houston were told to stay put, not evacuate. It seems this is the normal plan with severe flood warnings. Where would six million people go? The roads are flooded and impassible in places.

      People have suggested donating to the American Red Cross or local charities.
